1. Agreement and Acceptance

These Terms of Service (the “Terms”) are a legally binding agreement between you (“you,” “your,” or “User”) and 3G ASESORÍA TÉCNICA ESPECIALIZADA (“DashMail,” “we,” “us,” or “our”) governing your use of DashMail: Visual Workspaces for Gmail, the DashMail Chrome extension, website, subscription features, and related services (collectively, the “Service”).

By installing, accessing, purchasing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not install or use the Service.

2. What DashMail Provides

DashMail is a productivity extension that adds a visual organization layer to Gmail. It can organize Gmail labels and user-defined searches into dashboards, boards, tiles, unread counts, and message views, and may provide visual search tools and other productivity features described on the website or within the Extension.

DashMail does not replace Gmail. Your Gmail account, Gmail messages, Google Account, and Google services remain governed by Google’s own terms, policies, and technical limitations.

3. New and Evolving Service

DashMail is a newly launched product and may be provided in early or evolving versions. Features may be added, removed, changed, or refined as we respond to technical requirements and user feedback. We do not promise that every feature currently shown in a demonstration, roadmap, or marketing page will remain unchanged or be available indefinitely.

Early versions may contain defects, compatibility limitations, or unexpected behavior. We will use reasonable efforts to maintain and improve the Service, but we do not guarantee that every issue will be resolved or that the Service will support every Gmail configuration, browser environment, or future Gmail interface.

4. Eligibility

The Service is intended for users who are at least 18 years old, or who otherwise have the legal capacity to enter into these Terms under the law applicable to them. By using the Service, you represent that you meet the applicable requirement.

5. Google Account and Gmail Access

DashMail uses Google OAuth 2.0 and the Gmail API. The current Gmail permission requested by the Extension is the read-only scope https://www.googleapis.com/auth/gmail.readonly. You authorize DashMail to access the Gmail information necessary to provide the Service through that permission.

You remain responsible for the security of your Google Account and for activity occurring through your Google Account. DashMail does not ask for or receive your Google password.

DashMail is an independent product. It is not affiliated with, sponsored by, or endorsed by Google LLC. Google, Gmail, and related marks are trademarks of Google LLC.

6. Privacy and Google User Data

Our collection, use, storage, and disclosure of personal information and Google user data are described in the DashMail Privacy Policy, which is incorporated into these Terms by reference.

DashMail does not sell Google user data, use Google user data for personalized advertising, or use Google user data to train general-purpose or third-party AI or ML models. Human access to Google user data is limited to the circumstances permitted by applicable policies and the Privacy Policy.

7. User Content and Workspace Settings

You retain ownership of content you create or provide through the Service, including dashboard names, tile names, search definitions, and other workspace configuration (“User Content”).

You grant DashMail a limited, non-exclusive, worldwide license to host, transmit, store, reproduce, and process User Content only as necessary to provide, secure, maintain, synchronize, and improve the specific Service features you use, and only for the duration reasonably necessary for those purposes. This license ends when the relevant User Content is deleted, except to the extent retention is required by law or legitimate security, accounting, dispute-resolution, or backup processes.

You are responsible for ensuring that the User Content you enter into DashMail does not violate applicable law or the rights of third parties.

8. Plans and Pricing

DashMail currently offers a free plan and a paid PRO plan. Features and limits for each plan are described on the DashMail website and may change as the Service evolves.

8.1 Free plan

The free plan currently provides a limited set of dashboards, tiles, and Gmail organization features. Current limits are published on the Service. We may modify the free plan, including its limits or included features, with reasonable notice where required by law.

8.2 PRO plan

The current published PRO pricing is $4.99 USD per month or $49.99 USD per year, unless a different price is shown at checkout or otherwise communicated before purchase. Promotional pricing, taxes, currency conversion, or payment-method charges may affect the final amount presented at checkout.

8.3 Billing

Paid subscriptions are processed through Stripe or another payment provider identified at checkout. By subscribing, you authorize the applicable payment processor to charge the selected payment method according to the billing terms shown when you purchase the subscription.

8.4 Automatic renewal

Unless otherwise stated at checkout, PRO subscriptions renew automatically at the end of each billing period until canceled. The amount and renewal frequency will be shown before purchase and in the relevant billing records.

8.5 Cancellation

You may cancel a recurring PRO subscription using the cancellation method made available by DashMail or its payment provider. Unless the cancellation is effective immediately under the applicable purchase flow, cancellation normally takes effect at the end of the current paid billing period, and PRO features remain available until that date.

8.6 Refunds

Except where a refund is required by applicable law or expressly offered by DashMail at purchase, subscription fees are not refundable and we do not provide prorated refunds solely because you cancel a subscription before the end of a billing period. This provision does not limit any mandatory consumer rights that apply to you.

9. Taxes

Applicable taxes, VAT, sales taxes, or similar charges may be added where required. You are responsible for taxes imposed on your purchase or use of the Service to the extent not collected by the payment provider.

10. Acceptable Use

You agree not to:

• Use the Service for unlawful, fraudulent, abusive, or malicious purposes.
• Attempt to bypass, disable, or defeat authentication, access controls, licensing restrictions, or technical safeguards.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the Service except to the extent such restriction is prohibited by applicable law.
• Interfere with the operation of the Service, Google services, or supporting infrastructure, including by sending unreasonable automated requests or attempting to circumvent documented API limits.
• Resell, sublicense, lease, distribute, or commercially exploit the Service except as expressly authorized by us in writing.
• Use the Service to infringe another person’s intellectual-property, privacy, confidentiality, or other rights.
• Misrepresent your identity or your authorization to access a Google Account, Gmail mailbox, or organization.

11. Intellectual Property

The Service, including its software, source code, interface design, trademarks, logos, documentation, visual assets, and other materials created by or for DashMail, is owned by DashMail or its licensors and is protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use the Extension and Service for your personal or internal business productivity purposes. No ownership rights are transferred to you.

12. Third-Party Services and Dependencies

DashMail depends on third-party services, including Google APIs, Gmail, Chrome, Cloudflare, Stripe, hosting providers, and other infrastructure that may be used to support the Service. Third-party services are controlled by their respective providers and may change their interfaces, policies, availability, pricing, limits, or security requirements.

We will make reasonable efforts to adapt DashMail to material changes in third-party platforms, but we are not responsible for failures, delays, limitations, or incompatibilities caused solely by a third-party service outside our reasonable control.

13. Availability, Maintenance, and Changes

We may modify, suspend, restrict, or discontinue all or part of the Service, including individual features, when reasonably necessary for maintenance, security, legal compliance, product development, third-party changes, or business reasons. Where appropriate and practicable, we will provide advance notice of material changes.

Scheduled maintenance, third-party outages, browser updates, Gmail changes, or other events may temporarily prevent some or all features from functioning.

14. No Professional or Mission-Critical Use

DashMail is a productivity tool. It is not designed or warranted as a backup system, records-management system, legal archive, compliance archive, emergency communication system, or mission-critical mail continuity service. You remain responsible for retaining and safeguarding records that you are legally required to preserve.

15. Disclaimer of Warranties

16. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including mandatory consumer rights, liability for fraud or willful misconduct where non-waivable, or other statutory rights.

17. Indemnification

To the extent permitted by law, you agree to defend and indemnify DashMail and its officers, directors, employees, and contractors against third-party claims arising from your unlawful use of the Service, your violation of these Terms, or your violation of another person’s rights through User Content or misuse of the Service. This obligation does not apply to the extent a claim is caused by DashMail’s own gross negligence, willful misconduct, or another circumstance for which indemnification cannot lawfully be required.

18. Suspension and Termination

18.1 Termination by you

You may stop using the Service and uninstall the Extension at any time. If you have a recurring PRO subscription, uninstalling the Extension does not necessarily cancel the subscription; you must use the available cancellation method for the subscription.

18.2 Suspension or termination by DashMail

We may suspend or terminate access to the Service if reasonably necessary to address security risks, fraud, abuse, violation of these Terms, legal requirements, or material misuse of the Service. Where practical, we will provide notice and an opportunity to remedy the issue, unless immediate action is reasonably necessary.

18.3 Effect of termination

Upon termination, your license to use the Service ends. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, indemnification, dispute provisions, and applicable payment obligations, will survive as required.

19. Changes to these Terms

We may update these Terms as the Service evolves or legal requirements change. We will update the “Last updated” date and, when appropriate, provide additional notice of material changes. Continued use of the Service after a revised version becomes effective constitutes acceptance to the extent permitted by law. If you do not agree to a material change, you should stop using the affected Service.

20. Governing Law and Disputes

These Terms will be governed by the laws of MEXICO, without regard to conflict-of-law principles, except to the extent mandatory consumer-protection laws in your place of residence provide otherwise.

The courts located in Tlajomulco de Zuñiga, Jalisco, México will have jurisdiction over disputes arising from these Terms, subject to any mandatory rights to bring a claim in another forum provided by applicable law.

21. Consumer Rights

Nothing in these Terms is intended to deprive you of mandatory rights or remedies available under consumer-protection, privacy, payment, or other applicable laws. If a provision of these Terms is unenforceable in your jurisdiction, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

22. Entire Agreement and Severability

These Terms, together with the Privacy Policy and any additional terms expressly presented at purchase or for a particular Service feature, constitute the agreement between you and DashMail concerning the Service. If any provision is held invalid or unenforceable, the remaining provisions will remain effective.

23. No Waiver

Our failure to enforce a provision of these Terms does not constitute a waiver of our right to enforce that provision later.
